Terms of use

These terms apply to anyone who creates an upTake account. By creating an account you accept them. Last updated: [À COMPLÉTER : date de mise en ligne].
1. The service
upTake links your posts, tracked links and releases to the visits and payments of your site, and writes a weekly report. It is published by the company named in the legal notice.
2. A free beta, provided as is
- upTake is in public beta. It is free during the beta.
- The service is provided as is, without any guarantee of availability, accuracy or fitness for a particular purpose.
- Features can change or be removed, and data can be lost. Keep your own copy of anything you cannot afford to lose; you can export your data from Settings at any time.
- Numbers marked “estimated” are approximations. Do not rely on them alone for accounting, tax or legal decisions.
- If paid plans are introduced, you will be told before anything is charged. Nothing is charged without your explicit agreement.
3. Your account
- You must be able to enter into a contract, and give a working email address.
- You are responsible for what is done with your account and for keeping your access to it safe.
- You only add sites, Stripe accounts and GitHub repositories that you own or are allowed to connect.
4. What is not allowed
You must not use upTake, and in particular its short links, to:
- run phishing, scams, or any attempt to obtain passwords, payment details or personal data by deception;
- send spam or unsolicited bulk messages;
- link to malware, or to content that is illegal under French or European law;
- hide the real destination of a link in order to mislead people. Redirect links can only point to your own site or to a short list of well-known services;
- track the visitors of a site you do not operate;
- overload, probe or disrupt the service, or get around its limits.
5. Suspension and termination
- We can disable a link, or suspend or close an account, without notice, when these terms are broken. A disabled link shows its owner why it was disabled.
- We can end the beta, with reasonable notice sent to your account email whenever possible.
- You can delete your account at any time from Settings. Deleting it deletes your projects and their data.
6. Your data and your visitors’ data
- Your content stays yours. You allow us to host and process it only to provide the service.
- For the data of the visitors of your site, you are the data controller and upTake is your processor. The data processing agreement is part of these terms.
- You are responsible for informing your own visitors, and for collecting their consent where your country requires it, in particular if you turn on the option that remembers visitors for 90 days.
- What we collect is described in the privacy policy.
7. Liability
- To the extent allowed by law, we are not liable for indirect loss, such as lost revenue, lost profit, lost data or lost business.
- The beta being free, our total liability towards a professional user is limited to [À COMPLÉTER : plafond de responsabilité, à valider par un juriste].
- Nothing in these terms limits liability that cannot be limited by law, or the rights consumers have under mandatory law.
8. Changes to these terms
We can change these terms. When a change matters, we tell you by email or in the app before it applies. If you keep using upTake after that, you accept the new terms.
9. Governing law
These terms are governed by French law. Any dispute that cannot be settled amicably is brought before the courts of [À COMPLÉTER : ville du tribunal compétent], unless mandatory law gives jurisdiction to another court, in particular for consumers.
